1. Acceptance of Terms

By using our website or contacting us to request services, you confirm that you are at least 18 years of age and have the legal authority to enter into a binding agreement. If you are acting on behalf of a property owner or legal entity, you represent that you have the authority to bind that party to these terms.

2. Description of Services

WaveVista Weston Sunrooms & Patios provides residential sunroom construction, patio enclosure installation, screen room installation, and related outdoor living addition services in Weston, FL and surrounding South Florida communities. Services include but are not limited to sunroom additions, four season sunrooms, three season sunrooms, patio enclosures, custom sunrooms, solarium installation, screen room installation, and patio cover installation.

All services are subject to a signed written contract between the Company and the client. These Terms and Conditions supplement but do not replace the terms of any signed project contract.

3. Estimates and Pricing

Written estimates provided by WaveVista Weston Sunrooms & Patios are based on the scope of work described at the time of the estimate. Estimates are not binding contracts. Final project pricing is established in a signed written agreement between the Company and the client.

Prices may change if the scope of work changes, if unforeseen site conditions are discovered during construction, or if material costs change between the time of the estimate and the start of the project. Any changes to the original scope of work will be documented in a written change order signed by both parties before additional work proceeds.

All prices are stated in US dollars and include applicable Florida state sales tax where required by law. Permit fees are typically itemized separately in project contracts.

4. Scheduling and Cancellation

Project start dates are subject to permitting timelines, HOA approval processes, material availability, and weather conditions. We will communicate scheduling updates to you throughout the project.

If you need to cancel or postpone a scheduled project, please contact us as soon as possible. Cancellation terms - including any deposits or payments that may be retained - are specified in your signed project contract. Deposits made to cover permit fees or special-order materials may not be refundable if those costs have already been incurred.

We reserve the right to reschedule work due to weather conditions that make construction unsafe or impractical, including severe storms, hurricanes, or excessive rain. We will notify you of any weather-related delays as promptly as possible.

5. Payment Terms

Payment terms are specified in each individual project contract. In general, projects require a deposit at contract signing, progress payments at defined milestones during construction, and a final payment upon project completion and client walkthrough.

Payments are due on the dates specified in your project contract. Late payments may be subject to interest charges as specified in the contract. Work may be paused if payment is not received within the timeframe specified.

We accept payment by check, bank transfer, and other methods as specified in your project contract. A lien waiver may be issued upon receipt of final payment in full.

6. Permits and HOA Approvals

All required building permits will be obtained by WaveVista Weston Sunrooms & Patios prior to commencing construction. Permit fees are charged at cost and itemized in the project contract.

The client is responsible for obtaining written HOA approval where required. We will assist by providing the drawings and documentation your HOA needs, but the client must submit the application to the HOA and obtain written approval before construction begins. Construction cannot begin without both a valid building permit and any required HOA approval.

7. Warranty Disclaimers

WaveVista Weston Sunrooms & Patios provides a written workmanship warranty on completed projects as specified in your project contract. The terms, duration, and coverage of the workmanship warranty are set forth in the signed project agreement.

Manufacturer warranties on materials, windows, roofing panels, and other components are passed through to the client and are subject to the terms set by the manufacturer. We will assist in processing warranty claims where possible.

Warranties do not cover damage caused by storms, flooding, acts of God, improper maintenance, modifications made by parties other than WaveVista Weston Sunrooms & Patios, or normal wear and tear. The website and its content are provided "as is" without warranties of any kind, express or implied.

8. Limitation of Liability

To the fullest extent permitted by applicable law, WaveVista Weston Sunrooms & Patios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from our services shall not exceed the total amount paid by you to us under the applicable project contract. This limitation applies to the fullest extent permitted under Florida law.

9. Dispute Resolution

If a dispute arises between you and WaveVista Weston Sunrooms & Patios, we encourage you to contact us first at info@westonsunroomsnpatios.com or (786) 957-5827 so we can work to resolve the matter informally.

If we are unable to resolve the dispute informally, the parties agree to attempt mediation before pursuing any other legal remedy. Any legal proceeding that cannot be resolved through mediation shall be brought exclusively in the state or federal courts of Broward County, Florida, and both parties consent to personal jurisdiction in those courts.

10. Governing Law

These Terms and Conditions and any dispute arising from your use of our website or services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

11. Website Use

You may use our website for lawful purposes only. You agree not to use the site to transmit any material that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable. You agree not to attempt to gain unauthorized access to any part of the website or its underlying systems.

All content on this website - including text, images, and graphics - is the property of WaveVista Weston Sunrooms & Patios or its content providers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.
